Subsidi Kerajaan bakal Dihapuskan - Tuan Ibrahim.

10 Oct 2011 1:17PM

KUALA LUMPUR 10 Okt.

Harakahdaily

ADUN BATU LINTANG SEE CHEE HOW SIFATKAN BELANJAWAN 2012 SEBAGAI YANG TERBAIK

LAWYER: PAS cannot go hudud

(The Star) - Despite the PAS bravado about implementing the hudud law in Kelantan without the approval of the Federal Government, it cannot be done unless the Federal Constitution and other laws are amended.

Human rights and constitutional lawyer Syahredzan Johan said the barriers set by the Federal Constitution and other legal provisions governing Islamic laws made it impossible for PAS to make its hudud plan a reality.

He said the Syariah Courts (Criminal Jurisdiction) Act 1965 provided limits to the jurisdiction of Syariah Courts in meting out punishment.

“Under the Act, Syariah Courts cannot mete out punishment of a jail term exceeding three years, fine of more than RM5,000 or whipping of more than six strokes, or any combination thereof.
“Under hudud, there are punishments such as stoning or amputation,” he said.

Kelantan Mentri Besar Datuk Nik Aziz Nik Mat had said that the state government would set up a special technical committee to implement the hudud law.

Syahredzan said hudud law also violated the provision on equality under the Federal Constitution that stipulates everyone is equal before the law.

“The punishment for a Muslim under hudud could be more severe than for a non-Muslim for the same offence,” he said.

Since the hudud jurisdiction is non-discretionary, Syahredzan said any person convicted would have no room for appeal.

“Although it takes a lot to convict a person since the evidential burden is quite high, it may also expose a Muslim suspect to double prosecution and punishment, one under the civil law and one under hudud,” he said.

DAP national chairman Karpal Singh also said it was wrong for the Kelantan government to say that it was ready to implement hudud without the approval of the Federal Government.

He said it was not the Federal Government's place to sanction hudud as it was the Constitution which must be amended.

“As for DAP, we have reiterated that hudud is unconstitutional. Pakatan Rakyat leadership needs to sit down and find ways to overcome this,” he said.

MCA Youth chief Datuk Dr Wee Ka Siong called on Pakatan to come clean and inform the people of its stand on PAS.

“Is Kelantan a Pakatan or PAS government. Pakatan must answer this question. Is PAS part of Pakatan?” he questioned.

Sultan: Wujud cubaan pesong akidah

Park at your own risk’ no longer applicable

Posted on October 10, 2011, Monday

SIBU: Management of premises and car park operators who charge for the use of their parking space must immediately remove the ‘Park at your own risk’ notice as it is no longer applicable.

Wan Ahmad Uzir Wan Sulaiman

Ministry of Domestic Trade, Cooperatives and Consumerism (MDTCC) state director Wan Ahmad Uzir Wan Sulaiman clarified yesterday that these two entities were liable for losses suffered as result of break-in or vandalism.

He warned that a hefty fine could be meted out against offenders.

“Putting up the notice ‘Park at your own risk’ contravenes the Consumer Protection Act 1999, under the new Section 21A General Safety Requirement for Services, if the management of premises or car park operators charge for the use of their parking space.

“They can no longer claim that they are not liable to any damages to vehicles parked in their premises. In other words, they cannot use the notice as an excuse for not providing security to their customers’ vehicles and properties,” Wan Uzir told The Borneo Post.

He was asked if operators in paid car parks are liable to damages to vehicles as a result of break-in or vandalism while under their care.

“Upon conviction, offenders can be fined up to RM250,000 for the first offence, and up to RM500,000 for subsequent offence,” he warned.

He advised car owners to report to the ministry if operators refused to take responsibility for any damages to their vehicles while parked in the (operators’) premises.

Wan Uzir, however, clarified that the Act was not applicable if the car parks were provided for free.

Rude awakening for DAP’s rural dreams

Posted on October 10, 2011, Monday

No one shows up for party’s Dayak seminar

KUCHING: It was a rude awakening for the Democratic Action Party’s (DAP) dreams of penetrating rural areas in the state when not a single person turned up to attend its Dayak Consultative Council (DCC) seminar yesterday.

IT'S EMPTY: No one but the organisers and restaurant staff can be seen at the seminar venue.

The DCC seminar was scheduled to be held in a local restaurant at Siburan (Mile 17, Kuching) at 1.30pm.

By 2.30pm, no one from the target audience showed up and the organisers were forced to finally call it off.

The seminar, organised by DCC, aimed to prepare for DAP’s move from strictly urban Chinese-majority areas into Bumiputera and rural areas in the coming parliamentary election and to supposedly provide related consultative services to rural folk.

Among those from the party present at the venue were state DAP chief Wong Ho Leng, secretary Chong Chieng Jen, Serian branch chairman Edward Andrew Luak and DCC chairman Dr John Brian Anthony.

At a press conference held after the seminar was cancelled, Wong admitted that it would be a great challenge for DAP to penetrate Sarawak’s rural areas in the coming parliamentary election.

Siburan is located in the Bengoh state constituency, which is presently held by the Barisan Nasional (BN) under the Sarawak United People’s Party’s (SUPP) Dr Jerip Susil, who is Assistant Minister of Public Health.

Bengoh, along with Tarat, is under the Mambong parliamentary constituency, which is currently held by BN under Parti Pesaka Bumiputera Bersatu’s (PBB) Datuk Dr James Dawos Mamit, who is Deputy Minister of Tourism.

Besides Mambong, the DAP has also expressed interest in contesting in Mas Gading, currently held by BN through the Sarawak Progressive Democratic Party’s (SPDP) Datuk Dr Tiki Lafe – National Service Training Council chairman, as well as Serian.

DAP has set up a centre in Serian to try to wrest the seat from BN’s Sarawak United People’s Party (SUPP).

SUPP’s Datuk Richard Riot Jaem, who is Deputy Minister of Foreign Affairs, has held the seat for five terms since 1990.

All three parliamentary seats are Bidayuh majority areas.

NRD denies issuing fake identification cards in electoral roll

Posted on October 7, 2011, Friday

KUALA LUMPUR: The National Registration Department (NRD) has denied issuing fake identification cards which were allegedly listed in the Election Commission’s (EC) electoral roll.

The department said there was no need to set up a royal commission of inquiry to investigate such allegations as the department only issued identification cards to eligible individuals based on provisions in the country’s law.

“We would like to stress that the NRD has never issued fake documents and only provided authentic records to the EC for the purpose of checking the identity of electors,” the department said in a statement yesterday.

The PAS Youth was recently reported to have sent a memorandum to the NRD, urging them to set up a royal commission of inquiry to investigate the use of country code ‘71’ and what the movement claimed as the existence of fake identification details in the electoral roll.

The NRD said the allegation was not true.

Explaining the issue of individuals claimed to have the same name and almost the same identification card number, the department said records showed that nine of 10 similar names were different individuals based on their photos and fingerprints.

“Their only similarity is the name and birth date, while the 10th person, Azinah binti Mohd Fazin (800820-02-5150), has no record with us,” the statement added.

The NRD further clarified that the country code 71 found on identification cards had been in use since 1990.

At that time a special code for foreign countries was not available and that the births of Malaysians and permanent residents abroad were registered with that code.

“Starting 2001, special country codes were given to differentiate those who were born overseas,” it said, adding that the code 71 was valid. The 12-digit identification number on the cards, which is being used since 1990, was a combination of birth date, birth state or country code and a computer-generated serial number, he said.

The list of birth country codes can be obtained from the National Registration Department’s official website, www.jpn.gov.my. — Bernama

‘Mustahil Anwar mampu lakukan aksi fitnah’
